What is asylum?

According to Canadian immigration laws, a person expelled from the country or in need of protection can apply as a refugee in Canada.

Who are called refugees?

1- A person in need of support:

People in need of support are those who, if they return to their country, will be tortured, oppressed, or punished, and their lives will be in danger.

2- A person expelled from the homeland:

People expelled from the country are people who are abroad and cannot return to their country due to the fear of torture or arrest due to their race, religion, political beliefs, nationality or cooperation with a certain social group.

Which countries can applicants declare asylum?

The applicant must be from one of the declared countries that are abbreviated as DCO: It is called Designated Country of Origin, although the timing is different for the mentioned countries. To see the mentioned countries or DCO, refer to the following address.

Government bodies that follow refugee affairs in Canada:

1- Immigration, Refugees and Citizenship Canada IRCC

– Checking the validity of your asylum application while in Canada Issuing a work permit Federal IFH insurance

2- Canada Border Services Agency CBSA

– Examining your application at the border and making a decision on the order of your departure from Canada.

3- Immigration Department IRB-RPD support department – Asylum review of your asylum application in the BOL form, collection of documents and evidences that have been presented to you, decision to accept or reject the asylum application

Steps to apply for asylum in Canada:

There are two different timelines for applying for asylum in Canada:

1- Applying for asylum at the Canadian border

first stage :

– Completion of the interview and the justification of the application at the entry border of Canada, if it is justified, you will receive the following items:

The first application form-BOC, which must be completed within 15 days and given to the Immigration and Asylum Board.

If you are among the DCO countries – the specified countries, the date of review and hearing of your asylum application is 45 days after submitting the form.

If you are from a country other than the designated countries, you will be given a date up to the next 60 days.

second stage :

On the 15th day, submit the application form to the Immigration and Asylum Board.

third level :

– 10 days before the decision meeting, submit the evidence and documents on your claim to the Immigration and Asylum Board.

Fourth step:

– The countries specified in the DCO receive 45 days and other countries 60 days to review the request and hear the request at the Immigration and Asylum Board.

2- Submission of asylum application to IRCC – Immigration, Refugees and Citizenship Canada

first stage:

Go to the IRCC – Immigration, Asylum and Citizenship Department or get the asylum forms from this address and fill them.

second stage :

Go to IRCC – Immigration, Asylum and Citizenship Department and submit the completed forms. Note that you should be there before 10 am and if you cannot speak English or French, be sure to go with a translator. The forms will be checked and you will be notified of a date for the interview session.

third level :

Attend the competency review session. If your request is accepted, you will be notified of the date of review of the case, which will be within the next 30 days for specific DCO countries and a maximum of 60 days for non-DCO countries.

10 days before the decision meeting, submit the evidence and documents on your claim to the Immigration and Asylum Board.

Fourth step:

– The countries specified in the DCO receive 45 days and other countries 60 days to review the request and hear the request at the Immigration and Asylum Board.

Application acceptance:

If the request is accepted:

If you are not called up to 15 days after the meeting, you can apply for permanent residence at IRCC. If you are a DFN, you must wait 1 year to apply for permanent residence.

Request rejection:

If the request is rejected:

1- Request legal help.

2- Follow up within 15 days through refugee review – RAD.

3- Apply for PRRA.

5- Ask for humanitarian aid.
